Hughes said his client pulled off the suitcase and was about to search it when her supervisor instructed her to let the bag go through without a search. Hughes explained that sometime back while Smith was on duty, the sniffer dog ran to a suitcase which fell off the scanner and sniffed it but found nothing. Hughes told the court that the suitcase, Smith later found out, belonged to the husband of the same top ranking law enforcement figure. Hughes also highlighted the fact that the main witness in the case is charged in the US and hence it would be almost impossible for the police to prove a case of conspiracy.After listening attentively to the application by both lawyers Magistrate Octive-Hamilton described the facts of the case as being ‘very interesting’. She then indicated to the police prosecution that it was their time to address the court.Police Prosecutor Joel Ricknauth did not object to bail, which was granted to the tune of $35,000 each.
